One of the big pitfalls of starting a small business, such as real estate investing, is how to protect your personal assets from your business investments, and the other way around. If you buy everything in your personal name, you run the risk of a single lawsuit wiping out not only your investment, but also your personal property. As such, I generally recommend that  all small business owners incorporate their business in some way as to provide maximum reasonable protection for your assets.

There is one good reason to buy property in your own name solely, and that is for a refinance.  If you buy real estate and plan to refinance the property to get cash out, or to pay off a hard money loan, almost all conventional banks will require the property be in your own name.  If you know this is your plan going in, then I recommend you buy the property in your personal name and keep it in your personal name until the refinance takes place. This will leave you exposed to the liability of the security deed, and any consequences of foreclosure or defaulting on the loan, but it is the only way to get the refinance done in the first place.  Buying originally in your own name will save you from troubles with possible seasoning issues down the road.  Even in this instance, I still recommend putting the property into a business entity of some sort after the refinance is complete. David LindahlDavid Lindahl has rehabbed over 820 houses in just under 10 years and currently owns over 7,400 apartment units. Starting out as a struggling landscaper with no experience in construction, Dave accepted an opportunity to renovate a foreclosed house for a local bank during the wintertime when there was no landscaping to do in Boston.

The job was completed mostly with the advice of relatives and friends who knew how to do the work. After completing the first house, he did another and then (after getting over his initial fears) began to buy and hold small apartment buildings for himself. Read More→

Atlanta REIA Main MeetingWow, our November 1st Atlanta REIA Meeting was our biggest and best yet! A lot of new friends and old ones turned out last night to hear Dyches Boddiford speak on creative financing techniques for many your potential real estate investment deals. Including Dyches, there were five Georgia Real Estate Investors Association (GaREIA) past Presidents in attendance including Debby Henning, Steve Jordan, Jeff Nix and Don Derosa. If Gordan Catts had been in attendance, there would have been six! Atlanta REIA truly appreciates all of the support that GaREIA leaders and members, past and present, have been showing our new REIA group. Thank you everyone who attended our November Atlanta REIA Main Meeting and became Atlanta REIA Charter Members!

I must admit, hearing Dyches speak last night was like drinking water from a fire hose. Though what he teaches is more advanced and caters more to seasoned investors, he offered exactly what our group needed to hear in our troubled economic times. Simple investing and financing techniques for the  new investor and much more creative, outside-of-the-box, investing and financing strategies for the seasoned investor that are capable of generating large sums of equity and cash flow today and in the near future. Not only did I learn a few new things from Dyches, but he also reminded me of a few techniques that I had long forgotten that are totally applicable to today’s economy and real estate market.
